Legal Fees for Purchase

Please find below details of our Purchase Legal Fees, disbursements and other associated costs:

  1. Our Legal Fees cover the work required to complete your purchase, including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (SDLT) if the property is in England, or Land Transaction Tax (LT) if the property you wish to buy is in Wales.
  2. Land Registry fee – We can advise on whether the on-line discount is available.
  3. Land Registry searches – This is £3 and if you are buying with a mortgage this will be an additional £2 per owner 
  4. Search fees on purchase of property. Typically around £300
  5. Bank Transfer fees of £30.00 plus VAT at 20% per electronic payment exceeding £25,000.00.
  6. Stamp Duty Land Tax on purchase of property. You can ascertain the amount here https://www.gov.uk/stamp-duty-land-tax/residential-property-rates
  7. In Leasehold cases, there may be additional charges payable to the Landlord or Managing Agent. We will not know these until we receive the Management information from the seller.

  • New Build property:  please add £100.00 plus VAT at 20% to the Legal Fees above. In such cases, the postal scale of Land Registry fees will most likely apply.
  • Leasehold property:  please add £100.00 plus VAT at 20% to the Legal Fees above.
  • Shared Ownership: please add £100.00 plus VAT at 20%to the Legal Fees above.
  • Help to Buy Loans:  please add £100.00 plus VAT at 20% to the Legal Fees above.

The Transaction

For residential purchases we estimate 4-6 week from issue of contract to papers to achieve exchange of contracts, and 1-2 weeks after this to completion. 

However the transaction is dependent on factors which are outside of our control such as mortgage offers and the other parties in the chain.

The key stages involved in the transaction are:

  • Carry out ID checks, ensure finances are in place to fund purchase and instruct lender’s solicitors if needed
  • Receive and report on contract documents
  • Instruct and report on searches
  • Make any necessary enquiries of seller’s solicitor
  • Send final documents to you for signature
  • Exchange contracts
  • Arrange for all funds needed for completion to be sent to us
  • Complete purchase
  • Dealing with Stamp Duty Land Tax and registration.

Legal Fees for Sale

Please find below details of our Sale Legal Fees, disbursements and other associated costs:

  1. Our Legal Fees cover the work required to complete the sale, including repayment of any mortgage on the property.
  2. Copy title from the Land Registry £6 – £12 Freehold and £15-£21 Leasehold
  3. A fee for Bank Transfers of £36.00 per electronic payment exceeding £25,000.
  4. In Leasehold cases, any charges made by the Landlord or Managing Agent for provision of information. You should ask them to provide this information as early as possible.

The Transaction

  • Prepare contract documents and submit to buyer’s conveyancer
  • Respond to enquiries made by buyer’s conveyancer
  • Send final documents to you for signature
  • Agree completion date
  • Exchange contracts
  • Receive the sale monies from your buyer’s conveyancer
  • Complete the sale and discharge any mortgage payment and pay estate agents.

Legal Fees for Remortgage

Please find below details of our Remortgage Legal Fees, disbursements and other associated costs:

If you are looking to release equity from your home through a remortgage or refinance, then your mortgage company may require you to hire a conveyancer to handle the paperwork.

For remortgaging we offer a fixed rate of £650.00 plus VAT at 20%.

Other disbursements/associated costs which you will incur in the transaction include:

  1. Copy title from the Land Registry £6 – £12 Freehold and £15-£21 Leasehold
  2. Local Search (£100 – £150) or Indemnity premium (£12 – £40) dependent on the requirements of your mortgage lender
  3. Land Registry fee –
  4. £36 per electronic bank payment.

The Transaction

From start to finish it normally takes between four and eight weeks to complete the remortgage process.

The key stages involved in the transaction are:

  • When switching to a new lender, the new mortgage company may request that a solicitor carries out local searches, or they may accept a no search indemnity policy, and checks the title of your property
  • We will arrange for you to sign the Mortgage Deed
  • Once all searches and checks have been completed, the new lender releases the mortgage funds, and the solicitor repays the previous lender
  • The solicitor then updates the Land Registry.

Legal Fees for Will writing

A straightforward Will writing service costs £250 plus VAT charged at 20%, whereas two individuals together will cost £375 plus VAT charged at 20%. Our costs may increase if the Will is complex, for example if a Trust has to be included.

Legal Fees for Lasting Power of Attorney LPA

There are two types of LPAs:

Property and Financial Affairs LPA: This allows your Attorney to make decisions about dealing with your bank accounts, paying bills and selling your home. These are valid if you have your mental faculties and simply require your Attorney’s help and assistance in dealing with your finances on your behalf. They also remain valid if you should lose mental capacity in the future.

Our legal fees for this work are £450+VAT charged at 20% plus any court fee.

Health and Welfare LPA: This allows your Attorney to make decisions about life sustaining treatment, your care and where you live. These only come into effect if you should no longer have capacity.

The Lasting Powers of Attorney must be registered with the Office of the Public Guardian (OPG). 

Our legal fees for this work are £450+VAT charged at 20% plus any court fee.

 

Legal Fees for Probate & Administration of Estates

Where Encore Legal are instructed in administering an estate we will:

  • Discover any reasonable assets and liabilities within the estate
  • Draft the required Inheritance Tax Return and settle any Inheritance Tax owing
  • Prepare a Statement of Truth for signing by the Executor(s) or Administrator(s)
  • Seek a Grant of Representation
  • Collect in assets and settle liabilities
  • Produce the Estate Accounts
  • Deal with the tax affairs of the estate incurred during the period up until the date of death and during the period of administration
  • Facilitate the distribution to beneficiaries and/or the transfer of assets.

A number of disbursements are likely to be incurred during estate administration. These are quoted exclusive of VAT which is currently 20%:

  • Probate fee – payable to Her Majesty’s Courts and Tribunals Service is £155.
  • Sealed copies of the Grant of Representation – £1.50 each at time of application.
  • Bankruptcy searches – £2.00 per name.
  • Dealing with the Grant of Representation only with an IHT205 – £1,250
  • For IHT400 and obtaining the Grant of Representation– from £2,500

As well as the above disbursements, if a legal advisor deals with the estate administration on behalf of an Executor or Administrator, legal fees will be incurred. 

Encore Legal fees in relation to estate administration are calculated on the basis of the time actually spent administering the estate in accordance with your instructions. 

David Durkin-Finch who would be responsible for this work has an hourly rate of £229.00 plus VAT at 20%.

By way of an estimate, we usually find that our fees amount to approximately 3% of the gross value of the estate excluding VAT.  The gross value of the estate is the total value of all assets within the estate before the deduction of any debts and liabilities.
